LAWYER TO APPEAL COURT DECISION TO KEEP KHODORKOVSKY JAILED
MOSCOW. June 16 (Interfax) - Karina Moskalenko, a lawyer for former Yukos CEO Mikhail Khodorkovsky, told a news conference on Wednesday evening that she will appeal the refusal of a Moscow court to release the defendant from custody. Moskalenko qualified the current detention of Khodorkovsky and the head of Menatep company, Platon Lebedev, as illegal. But "before we appeal to the European Court of Human Rights, we must use up all means of legal defense within the country, and so I will definitely appeal today's refusal [to free Khodorkovsky] with the Moscow City Court," she said. She also said she had appealed a May 20 order by Moscow's Meshchansky Court. That day, in ordering the hearing of the Khodorkovsky case, the court automatically left the accused under arrest, instead of putting the issue of his detention or release on the agenda for an open court session. Moskalenko said the appeal is due to be heard on June 21.
